Documents do you need to prepare:

Regulations of Trademark Fees (extract from TIPO)

 Amended and Promulgated on September 4, 2008, by the Ministry of Economic Affairs; enforced on August 26, 2008.

Amended and Promulgated on December 27, 2010, by the Ministry of Economic Affairs; enforced on February 1, 2011. 

Article 1

 

These Standards are prescribed in accordance with Article 11-2 of the Trademark Act (hereinafter "the Act"). 

Article 2

 

The filing fee is prescribed as follows: 

1. For a trademark or collective trademark, the payable filing fee is the amount derived from the number of the classes of the designated goods or services. The amount for each class is calculated as follows: 

(1) For an application covering Classes 1 through 34, NT$3,000 per class covering 20 items or fewer of designated goods, plus NT$200 per item over 20 items of designated goods.

(2) For an application covering Classes 35 through 45, NT$3,000 per class; while retail services of specific goods in Class 35 are designated, plus NT$500 per item over 5 items of designated retail services of specific goods.

2. For a collective mark or certification mark, NT$5,000 per application. 

When filing for trademark registration in electronic format as provided under Article 14 of the Act, the filing fee referred to the preceding paragraph shall be reduced NT$300 per application; while all of the designated goods or services are identical with the recommended terms in e-filing system, the filing fee shall be reduced NT$300 more per class.

Article 3

 

 

The registration fee is prescribed as follows: 

1. For a trademark or collective trademark, NT$2,500 per class; or if payment by installments, NT$1,000 for the first installment and NT$1,500 for the second installment. 

2. For a collective mark or certification mark, NT$2,500 per application; or if payment by installments, NT$1,000 for the first installment and NT$1,500 for the second installment. 

Article 4

 

The fee for a renewal application is prescribed as follows:

1. For renewal of a trademark or collective trademark, NT$4,000 per class. 

2. For renewal of a collective mark or certification mark, NT$4,000 per registration. 

When a renewal application has been withdrawn before the notification of approval has been made, the applicant may request for a refund of the renewal fee referred to the preceding paragraph.

Article 5

 

The fee for a division application is prescribed as follows:

1. For division of a registration application, NT$2,000 for each additional application after the division. 

2. For division of a trademark registration, certification mark registration, or collective trademark registration, NT$2,000 for each additional registration after the division. 

3. For division of a trademark registration, certification mark registration, or collective trademark registration prior to the final decision of an opposition, invalidation, or revocation action against the registration, NT$2,000 will be additionally charged in addition to the payment of the fee under Paragraph 2 of this Article. 

Article 6

 

 

Other filing fees are prescribed as follows:

1. For an application to change application or registration particulars, NT$500 per application; for one application to change the same matters for multiple trademark/certification mark/collective trademark/collective mark applications or registrations, the fee is payable based on the number of applications or registrations to be changed. 

2. For an application to restrict the designated goods or services of a registered trademark, NT$500 per application. 

3. For an application to record license or sublicense, NT$2,000 per application. 

4. For an application to revoke license or sublicense recordation, NT$1,000 per application. 

5. For an application to record assignment, NT$2,000 per application. 

6. For an application to record pledge creation, NT$2,000 per application. 

7. For an application to record the extinguishment of a pledge, NT$1,000 per application. 

8. For an opposition action, NT$4,000 per class. 

9. For an invalidation action, NT$7,000 per class. 

10. For a revocation action, NT$7,000 per class. 

11. For an application to intervene in an opposition, invalidation or revocation action, NT$2,000 per application. 

12. For an application to issue certified documents, NT$500 per copy. 

13. For an application to review the official files of a case, NT$500 per application.

Article 7

 

For an application to issue a replacement registration certificate or re-issue a registration certificate, the fee is NT$500 per application. 

Article 8

 

These Standards take effect from the date of promulgation. 

The amendments to these Regulations promulgated on September 4, 2008 take effect as of August 26, 2008.

The amendments to these Regulations promulgated on December 27, 2010 take effect as of February 1, 2011.
